- Design defects: If another product design existed that would have prevented your injury, and if the cost of using this other design was less than the risk of someone getting injured, the company that designed the product is liable.
- Failure to warn: If the company knows the product has a dangerous quality, but failed to warn you about it, the company is liable. These types of failures can include missing safety shields on construction equipment and failure to include a safety warning on the product itself.
