Taking On Defective Product Makers

At Weems, Schimpf, Haines, Shemwell & Moore (APLC), our lawyers are concerned with helping people who were injured by defective products. We help consumers hold manufacturers responsible for negligence in design, manufacturing, or safety warnings.

If you were hurt by a dangerous or defective product, contact our products liability attorneys for a consultation.

All defective product lawsuits in Louisiana are governed by the Louisiana Product Liability Act. Under this statute, there are three types of product defects that are actionable in personal injury lawsuits:

  • Manufacturing defects: If the manufacturer failed to do something it normally would do in the manufacturing of that product, the manufacturer is liable. For example, if the manufacturer failed to tighten bolts and this caused the product to fail and caused your injury, you could sue the manufacturer.
  • Design defects: If another product design existed that would have prevented your injury, and if the cost of using this other design was less than the risk of someone getting injured, the company that designed the product is liable.
  • Failure to warn: If the company knows the product has a dangerous quality, but failed to warn you about it, the company is liable. These types of failures can include missing safety shields on construction equipment and failure to include a safety warning on the product itself.

If you are injured by a defective product in Louisiana, you need a law firm with the financial resources to hire the best experts to prove your case under the limitations of Louisiana’s Product Liability Act. Our lawyers will carefully evaluate your product injury case and, if we believe in it, invest the money that is necessary to help you get full compensation and damages.

We handle cases involving serious injuries and wrongful deaths caused by defective consumer products such as saws, lawnmowers, child car seats, and toys, as well as defective manufacturing equipment. In some of these cases, manufacturers had issued a recall because they knew the product was unsafe.
