Who Can Collect Wrongful Death Compensation?

Louisiana has special rules about who can recover compensation in the event of a wrongful death. Under these rules, there are four types of relatives who can file a lawsuit and collect compensation:

  • The victim’s spouse and children
  • The victim’s parents
  • The victim’s brothers and sisters
  • The victim’s grandparents

If anyone survives in a class of relatives that is closer to the victim than yours, you cannot file a wrongful death lawsuit. For example, if you are the victim’s mother and the victim has a surviving spouse, the spouse can file a lawsuit but you cannot.
